LAW NOTES
People in
the DPLS service area may be targets of fraudulent schemes and high-pressure
sales tactics. You can avoid becoming a victim by being aware of some of the
techniques used.
Telephone Solicitation schemes try to get your credit card number and
then use it to make unauthorized charges. Another type of telephone scheme
misrepresents a products value and price. Avoid these schemes by asking
questions and requesting written information. Always be suspicious if pressured
to make a quick decision or if you are asked to pay to claim a prize. NEVER
give your credit card number out over the phone unless you place the call to a
reputable business and are sure you are talking to the business you called.
Direct
Mail schemes send you a letter or a postcard saying you have won a prize or a
contest. This often is a front for a scam. Instructions tell you to respond to
the promoter with certain information. If you do, you will be called by someone
who may use high pressure sales pitches, scare tactics, and false claims to
deceive you and take your money. If a prize notification requires you to call a
900 number, which will cost you money to call, or asks for a credit card number
to claim the prize, be suspicious.
Home
Improvement Offers involve door to door sales promises of a special bargain for
a limited period of time. Be suspicious if the offer does not include a written
estimate or contract.
Unethical
fund raisers may use names similar to familiar charities to solicit money.
Before you give, request written information about the charity and how the funds
will be used.
Consumers
have specific rights to cancel certain home solicitation contracts, but the
cancellation time can be very short. If you feel you have been a victim of any
fraudulent or high pressure sales tactics, immediately contact a lawyer or your
local legal services office for advice. You can also contact the South Dakota
Attorney Generals Consumer Protection Division at 1-800-300-1986.
